THE BAIL PROCESS

Arrest

The bail bond process begins with the arrest of a suspect or defendant. In North Carolina, individuals are subject to arrest for a number of different reasons. These can include:

  • Spousal Abuse/Domestic Violence
  • Failure to Appear in Court
  • Possession of Drugs or Paraphernalia
  • Traffic Offenses/DWI

The defendant is brought to the local jail following the arrest, where the accused is processed and then presented to a Judge ( or magistrate).

Setting Bail

Once a defendant has been processed, he/she must wait in jail until a bail hearing. At this hearing, the defendant is brought before the Judge (magistrate) at the jail. The Judge will review the defendant’s criminal history and the nature of the alleged offense(s). Based on North Carolina law, the Judge will set the bond amount accordingly. ONLY AFTER THE BOND HAS BEEN SET BY THE MAGISTRATE CAN A BAIL BONDSMAN POST THE BAIL.

Processing

At the local jail, every defendant is then processed (also known as “booked”) according to the jail procedures of that jurisdiction. In general, the defendant is fingerprinted and photographed for proper identification. Then the accused may need to surrender personal items over to the jail. He/she may also be searched for contraband.

Costs Of Using A Raleigh Bail Bondsman

According to North Carolina, the bond fee limit is 15% of the total bail amount. This fee (premium) paid to Winston Bail Bonding is NON-REFUNDABLE. The premium varies on a case-by-case basis and may depend on the location and circumstances of the arrest. Nonetheless, we offer the most competitive rates in the Triangle as well as flexible payment arrangements.

An indemnitor, also known as a co-signer, must pay this premium and, in some cases, he/she may need to sign over collateral (house, car, art, or jewelry) to help guarantee that the defendant appears in court. If the defendant does not appear to ALL court dates, the co-signer is financially responsible for the full amount of the bond.

Once the co-signer has paid the premium, we can begin the process of posting bail. While it takes about 20 minutes for us to complete the administrative paperwork, the actual release time can vary. Some factors that can affect the release time include detention staff workload, shift changes, and even mealtimes. Nonetheless, release takes between 30 minutes to a couple of hours. By notifying Winston Bail Bonding at the time of the arrest, we can drastically reduce this wait.

Once the defendant is released, he/she will need to meet with a bond agent to complete the bond paperwork. We will keep in contact with the arrestee regarding these court dates.
