The Bail Process
The bail bond process begins with the arrest of a suspect or defendant. In North Carolina, individuals are subject to arrest for a number of different reasons. These can include:

The defendant is brought to the local jail following the arrest, where the accused is processed and then presented to a Judge ( or magistrate).
At the local jail, every defendant is then processed (also known as “booked”) according to the jail procedures of that jurisdiction. In general, the defendant is fingerprinted and photographed for proper identification. Then the accused may need to surrender personal items over to the jail. He/she may also be searched for contraband.
Once a defendant has been processed, he/she must wait in jail until a bail hearing. At this hearing, the defendant is brought before the Judge (magistrate) at the jail. The Judge will review the defendant’s criminal history and the nature of the alleged offense(s). Based on North Carolina law, the Judge will set the bond amount accordingly. ONLY AFTER THE BOND HAS BEEN SET BY THE MAGISTRATE CAN A BAIL BONDSMAN POST THE BAIL.

The premium varies on a case-by-case basis and may depend on the location and circumstances of the arrest. An indemnitor, also known as a co-signer, must pay this premium and, in some cases, he/she may need to sign over collateral (house, car, art, or jewelry) to help guarantee that the defendant appears in court. Once the co-signer has paid the premium, we can begin the process of posting bail. While it takes about 20 minutes for us to complete the administrative paperwork, the actual release time can vary. Some factors that can affect the release time include detention staff workload, shift changes, and even mealtimes. Nonetheless, release takes between 30 minutes to a couple of hours.
